Terms of Service

These Terms of Service (“Terms”) govern your access to and use of risenty.com, our online store, and the products and services made available through them (collectively, the “Services”).

The Services are operated by RISEGABE INC, doing business as Risenty Store (“Risenty,” “we,” “us,” or “our”). By accessing the Services or placing an order, you agree to these Terms. If you do not agree, please do not use the Services.

These Terms should be read together with our Privacy Policy, Shipping Policy, Refund & Return Policy, Warranty Policy, and any product-specific terms disclosed before purchase.

Terms at a Glance

1. Scope and Contracting Entity

These Terms apply to visitors, customers, and other users of the Services. When you purchase from Risenty Store, your sales contract is with RISEGABE INC, doing business as Risenty Store, unless a checkout or sales channel clearly identifies another seller before purchase.

If you buy through Shop, Facebook, Instagram, Google Shopping, or another platform, that platform’s mandatory terms and procedures may also apply. If those terms conflict with these Terms, the platform terms control only to the extent required for that transaction.

2. Eligibility and Accounts

You must be legally capable of entering into a binding contract in your place of residence, or use the Services with the permission and supervision of a parent or legal guardian.

You agree to provide accurate, current, and complete information when creating an account or placing an order. You are responsible for protecting your login credentials and for activity conducted through your account. Please notify us promptly if you believe your account has been accessed without authorization.

We may refuse, suspend, or close an account where reasonably necessary to address fraud, abuse, security risks, legal requirements, or material violations of these Terms.

3. Product Information

We make reasonable efforts to describe products accurately. Product images, colors, dimensions, packaging, and other visual details may appear differently depending on lighting, display settings, manufacturing updates, or reasonable production tolerances.

Unless expressly stated otherwise, accessories, display props, software, subscriptions, or services shown in an image are not included. The product title, description, specifications, variant selection, and order confirmation determine what is included.

If a material product detail is incorrect, your available remedy will be determined under our Refund & Return Policy, Warranty Policy, and applicable law.

4. Availability, Pre-Orders, and Purchase Limits

Products may be limited, discontinued, or available only in certain countries or regions. Adding an item to a cart does not reserve inventory.

Pre-order and back-order products may have estimated dispatch dates or windows shown on the product page. These dates are estimates and may change because of production, supplier, quality-control, customs, or transportation circumstances. If a material delay occurs, we will provide an updated estimate and any options required by applicable law.

We may apply reasonable quantity limits or cancel orders that appear to involve unauthorized resale, automated purchasing, pricing abuse, fraud, or circumvention of purchase limits.

5. Prices, Currency, Taxes, and Duties

Prices may change without notice, but a price change will not affect an order already accepted, except where a clear pricing error occurred and applicable law permits correction.

Displayed currency may be selected based on your location or settings. Your payment provider may apply exchange rates or fees that are outside our control.

Sales tax, VAT, GST, and similar transaction taxes collected by us will be shown at checkout. Import duties, customs charges, brokerage fees, and other destination charges may be payable by the recipient unless the checkout or shipping method expressly states that they are included or prepaid. Please review our Shipping Policy for additional details.

6. Orders and Contract Formation

Submitting an order is an offer to purchase. An automated acknowledgment that we received your order does not necessarily mean that we have accepted it. The sales contract is formed when we send an acceptance or dispatch confirmation, or otherwise begin fulfillment, unless applicable law provides otherwise.

We may decline or cancel an order before acceptance for legitimate reasons, including unavailable inventory, an obvious pricing or description error, payment failure, suspected fraud, shipping restrictions, legal restrictions, or inability to deliver to the supplied address. If payment has already been collected for a cancelled order, we will return the applicable amount to the original payment method.

You are responsible for reviewing the products, variants, quantities, price, and shipping details before submitting an order.

7. Payment

You authorize us and our payment providers to charge the amount shown at checkout using your selected payment method. You represent that you are authorized to use that payment method.

Payment information may be processed by Shopify and third-party payment providers under their own terms and privacy notices. We do not receive or store complete payment-card details where the payment provider processes them directly.

If a payment is reversed, disputed, rejected, or later identified as unauthorized, we may pause fulfillment, cancel the order, or seek payment of amounts lawfully due. This does not restrict a customer’s right to raise a good-faith payment dispute.

8. Shipping, Delivery, Title, and Risk

Processing times, estimated delivery times, tracking, customs responsibilities, address requirements, and shipping restrictions are described in our Shipping Policy. Delivery dates are estimates unless we expressly agree to a guaranteed date.

You must provide a complete and accurate delivery address. Please contact us promptly if a correction is needed. Address changes cannot be guaranteed after an order enters fulfillment.

Title to purchased products passes after we receive full payment and the product is delivered, unless applicable law requires a different result. Risk of accidental loss or damage passes when the product is delivered to you or a person designated by you, except where applicable law provides otherwise.

Nothing in this section limits our responsibilities for carrier selection, delivery, or damaged or missing goods where those responsibilities cannot legally be excluded.

9. Worry-Free Delivery®

For eligible orders, the cart may display optional Worry-Free Delivery® protection administered by Seel. Availability is determined dynamically and may depend on the destination, products, order details, and other eligibility criteria. If the option is not displayed for an order, it is not available for that order.

The fee is shown before checkout and may vary according to the cart value and other order factors. Selecting the option adds the displayed fee to your order. Coverage applies only if Worry-Free Delivery® appears in the completed order or Seel coverage confirmation.

Depending on the coverage issued for your order, eligible shipping events may include delay, loss, or damage in transit. Coverage, exclusions, claim windows, required evidence, and compensation are governed by the Seel terms and confirmation supplied for that order. 10. Order Changes and Cancellations

Please contact us as soon as possible if you need to change or cancel an order. We will make reasonable efforts to assist before processing begins, but changes and cancellations cannot be guaranteed after the order has entered fulfillment or been dispatched.

If an order can no longer be cancelled, you may request a return after delivery where eligible under our Refund & Return Policy and applicable law.

11. Returns, Refunds, and Exchanges

Return windows, eligibility conditions, exclusions, authorization steps, return shipping, inspection, deductions, and refund timing are governed by our Refund & Return Policy.

Do not send products to the address shown on the original shipping label or to any corporate or registered address. Contact us first and wait for written return authorization and the designated return instructions.

Refunds are normally made to the original payment method. Your bank or payment provider may require additional time to post the credit after we issue it.

12. Product Warranty and Statutory Rights

Eligible products may be covered by our Warranty Policy or by product-specific warranty terms disclosed before purchase.

Commercial warranty coverage is separate from rights and remedies provided by mandatory consumer law. If your local law provides a longer legal guarantee or more favorable remedies, those mandatory rights continue to apply.

13. Promotions, Discount Codes, and Gifts

Promotions may be subject to additional terms, eligibility rules, dates, product exclusions, quantity limits, or minimum purchase requirements. Unless expressly stated otherwise, discount codes cannot be combined, exchanged for cash, or applied retroactively.

If an order no longer meets a promotion’s conditions because of a cancellation or return, the refund may be recalculated to reflect the promotion actually retained, where permitted by law. Complimentary gifts may need to be returned with the qualifying purchase or their disclosed value may be deducted from the refund.

14. Third-Party Services, Tools, and Links

The Services may rely on or link to third-party providers, including Shopify, payment processors, carriers, analytics providers, social platforms, and Seel. Third-party services may be governed by their own terms and privacy notices.

We are not responsible for the independent content, policies, availability, or conduct of third-party websites and services. This section does not exclude responsibility for third parties acting on our behalf where the law makes us responsible for them.

15. Reviews, Feedback, and Other User Content

If you submit a review, photo, video, comment, suggestion, or other content, you confirm that you have the necessary rights and that the content is accurate to your knowledge, lawful, and does not violate another person’s rights.

You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, translate, adapt, publish, display, and distribute that content for operating, improving, and promoting the Services. This license continues only for as long as reasonably necessary for those purposes, subject to applicable law and any platform-specific terms.

We may moderate or remove content that is unlawful, misleading, abusive, infringing, irrelevant, contains personal information, or violates these Terms. We are not required to publish every submission.

16. Intellectual Property

The Services and their original text, layout, graphics, logos, software, and other content are owned by or licensed to Risenty and are protected by applicable intellectual-property laws. You may use the Services for personal, non-commercial shopping purposes only.

You may not copy, scrape, reproduce, modify, distribute, sell, reverse engineer, or commercially exploit our content or technology without permission, except where applicable law expressly allows it.

Product names, character names, artwork, logos, and trademarks belonging to manufacturers, licensors, artists, entertainment companies, and other rights holders remain the property of their respective owners. A product listing does not imply endorsement or affiliation beyond any relationship expressly stated on that listing.

17. Prohibited Uses

You may not use the Services to:

• Violate applicable law or another person’s rights.
• Submit false, fraudulent, deceptive, or unauthorized orders or payment information.
• Introduce malware, interfere with security, test vulnerabilities without authorization, or disrupt the Services.
• Collect personal information about others without a lawful basis.
• Use bots, scraping, or automated tools in a way that burdens the Services, bypasses purchase limits, or extracts protected content.
• Impersonate another person or misrepresent your identity, authority, or affiliation.
• Use the Services for unauthorized resale or other commercial exploitation.

18. Accuracy, Errors, and Service Changes

Occasionally, the Services may contain typographical errors, inaccuracies, or omissions relating to descriptions, pricing, promotions, availability, shipping, or other information. We may correct errors and update information. If a correction materially affects an order you already placed, we will notify you and provide any cancellation or refund option required by law.

We may modify, suspend, or discontinue features of the Services. We will not use such changes to remove rights that have already arisen under an accepted order.

19. Privacy and Electronic Communications

Our collection and use of personal information are described in our Privacy Policy. By using the Services, you acknowledge that electronic communications may be used for order confirmations, service notices, policy updates, and customer support.

Marketing communications are subject to your choices and applicable law. You may unsubscribe using the instructions in a marketing message, although you may still receive transactional or service-related communications.

20. Disclaimers

To the maximum extent permitted by law, the Services are provided on an “as available” basis. We do not promise that the website will always be uninterrupted, secure, or error-free, or that every display will reproduce product colors exactly.

Products are provided with the express warranties stated in our Warranty Policy and with any guarantees, conditions, and remedies required by applicable law. We do not exclude implied warranties that cannot legally be excluded.

21. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence where applicable, or death or personal injury caused by negligence.

Subject to the paragraph above and to the maximum extent permitted by law, Risenty will not be liable for indirect, incidental, special, exemplary, or consequential losses, or for lost profits, revenue, data, business, or opportunity, arising from use of the Services or a purchase, where such losses were not reasonably foreseeable when the contract was formed.

Where liability may lawfully be limited, our aggregate liability arising from a particular order will not exceed the amount paid for that order. This limitation does not reduce any refund, replacement, repair, statutory damages, or other remedy that applicable consumer law requires.

22. Your Responsibility for Misuse

To the extent permitted by law, you are responsible for losses, claims, or reasonable costs caused by your unlawful misuse of the Services, infringement of another person’s rights, or material breach of these Terms. This section does not require a consumer to compensate us for losses caused by us or for matters outside the consumer’s reasonable control.

23. Events Outside Reasonable Control

We are not responsible for delay or failure caused by events outside our reasonable control, such as natural disasters, severe weather, epidemics, war, civil disturbance, government action, customs restrictions, labor disruption, carrier-network failure, internet or utility outages, or supplier interruption.

We will take reasonable steps to reduce the effect of such an event and resume performance. If it materially prevents fulfillment, we will provide any notice, cancellation, or refund rights required by applicable law.

24. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate access where reasonably necessary because of fraud, unlawful conduct, security risk, repeated abuse, or a material breach of these Terms.

Termination does not affect rights and obligations that arose before termination, including payment obligations, accepted orders, returns, warranty claims, intellectual-property rights, and provisions that by their nature should continue.

25. Governing Law and Disputes

These Terms and contracts formed under them are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law rules.

If you are a consumer, this choice of law does not deprive you of mandatory protections provided by the laws of your country or region of residence. You may also bring a claim in any court or forum available to you under mandatory consumer law.

Before starting formal proceedings, we encourage you to contact us so we can try to resolve the issue. This does not limit your right to seek help from a consumer authority, payment provider, court, or other legally available forum.

26. General Terms

If any provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue in effect. A delay in enforcing a right is not a waiver of that right.

You may not transfer your rights or obligations under these Terms without our consent, except where applicable law permits. We may transfer our rights or obligations as part of a merger, reorganization, sale, or transfer of the business, provided this does not reduce your rights.

These Terms, the policies incorporated by reference, the product page, and the order confirmation form the agreement relating to your purchase. If product-specific terms conflict with these general Terms, the product-specific terms control for that product to the extent clearly disclosed and lawful.

Translations may be provided for convenience. If versions differ, the English version controls to the extent permitted by applicable law.

27. Changes to These Terms

We may update these Terms to reflect changes in the Services, business practices, or legal requirements. The revised version will be posted with an updated date. Changes apply prospectively and will not reduce rights that already arose under an accepted order unless the law permits and you agree.
